All product descriptions, specifications, pricing, availability, and offerings are subject to change without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit quantities or sales to any person, household, geographic region, or jurisdiction on a case-by-case basis.
Artwork appearing on our products may fall within one or more of the intellectual property categories described in Section 6 below.

When you place an order, you are making an offer to purchase products from Comfort Guild. Comfort Guild reserves the right to accept, reject, limit, or cancel an order for any lawful reason in its discretion.
Your order is not accepted until Comfort Guild confirms acceptance and payment has been successfully received and processed.
Please review your order carefully before submitting it. Because some products may enter production shortly after an order is placed, we may be unable to accommodate cancellation or modification requests after an order has been accepted.
If we reject, modify, or cancel an order, we will attempt to notify you using the email address, billing address, telephone number, or other contact information supplied with the order.
Purchases are subject to returns, refunds, replacements, or exchanges only as provided in our Refund Policy.
You represent and warrant that products purchased through the Services are for lawful personal, household, gift, or other permitted use and not for unauthorized commercial resale, counterfeiting, reproduction of our designs, or other use prohibited under these Terms.
The purchase of a physical product does **not** transfer any copyright, trademark, design right, license, or other intellectual property right associated with the product, artwork, branding, photography, graphics, or other content appearing on or in connection with that product, except as expressly stated in these Terms or required by applicable law.

## SECTION 4 - PRICES AND BILLING
Prices, discounts, promotions, and product availability are subject to change without notice.
The price charged for a product will generally be the price displayed at the time the order is placed and will be reflected in your order confirmation.
Unless otherwise expressly stated, posted prices do not include applicable taxes, shipping charges, handling charges, customs duties, import fees, or similar charges.
Prices available through our online store may differ from prices offered through third-party marketplaces, sales channels, promotions, or other stores.
Promotions may be governed by additional terms and conditions. If specific promotional terms conflict with these Terms, the promotional terms will govern with respect to that promotion.
You agree to provide current, complete, and accurate purchasing, payment, and account information for all purchases.
You represent and warrant that any payment information you provide is accurate, that you are authorized to use the payment method provided, that charges incurred by you will be honored by your payment provider, and that you will pay all charges incurred in connection with your order.

Comfort Guild is not responsible for delays caused by shipping carriers, fulfillment providers, customs processing, weather, supply-chain disruptions, incorrect addresses provided by customers, or events beyond our reasonable control.
To the fullest extent permitted by applicable law, title and risk of loss may pass to you upon transfer of the applicable shipment to the carrier.

# SECTION 6 - INTELLECTUAL PROPERTY
## 6.1 Comfort Guild™ Trademark and Brand
**Comfort Guild™** is used by us as a trademark and source identifier in connection with the goods and services offered by Comfort Guild.
We claim all common-law trademark, unfair competition, trade dress, and related rights available to us arising from our use of **Comfort Guild™** in commerce.
Comfort Guild's name, logos, branding elements, source-identifying graphics, slogans, product names, collection names, trade dress, and other brand identifiers may constitute trademarks or other proprietary rights of Comfort Guild, its affiliates, or its licensors.
You may not use the Comfort Guild name, Comfort Guild™ mark, logos, branding, or confusingly similar names, marks, domains, usernames, social-media handles, marketplace identities, product branding, or other source identifiers in a manner that is likely to cause confusion regarding affiliation, sponsorship, endorsement, origin, or association with Comfort Guild.
You may not use Comfort Guild branding in connection with counterfeit products, unauthorized reproductions, competing storefronts, advertisements, domain names, marketplace listings, metadata, paid-search advertising, social media accounts, or other commercial activities without our prior written permission.
Unless and until a particular Comfort Guild mark is federally registered, use of the “™” symbol represents our claim of trademark rights and should not be interpreted as a representation that the mark is federally registered.
Nothing in these Terms constitutes a waiver of any trademark or unfair competition rights available to Comfort Guild under federal, state, common, or other applicable law.
Shopify's names, logos, product names, service names, designs, and slogans are trademarks of Shopify or their respective owners.
Other names, marks, logos, artwork, or brands appearing through the Services may belong to their respective owners.
### 6.2 Store Content Generally
Except for underlying public-domain material as specifically described below, the Services and the materials associated with them may include intellectual property owned by or licensed to Comfort Guild.
This may include, without limitation:
- original artwork and illustrations;
- human-authored portions of AI-assisted works;
- original modifications, arrangements, or compositions;
- logos and branding;
- product photography;
- product mockups and presentations;
- graphics;
- written product descriptions and other copy;
- photographs and videos;
- website layout and design;
- collections and compilations;
- promotional materials;
- packaging designs;
- social-media content;
- original typography treatments or graphic arrangements; and
- the selection, coordination, arrangement, and presentation of content.
Collectively, such materials are referred to in these Terms as “Comfort Guild Content.”
Comfort Guild Content may be protected by copyright, trademark, trade dress, contract law, unfair competition law, or other applicable rights.
### 6.3 Artwork Categories
Comfort Guild products may incorporate artwork from several different sources. Intellectual property rights associated with a particular product therefore depend on the nature and origin of the artwork.
#### A. Original Human-Authored Artwork
Some artwork sold or displayed by Comfort Guild is originally created by human authors and is owned by Comfort Guild or used by Comfort Guild pursuant to an appropriate license or other authorization.
To the extent applicable, such artwork is protected by copyright and other applicable intellectual property laws.
Unless we expressly grant written permission, the purchase or possession of a product containing original artwork does not authorize you to reproduce, scan, trace, digitize, copy, distribute, modify, manufacture from, commercially exploit, sell, sublicense, upload, or otherwise use that artwork separately from the physical product purchased.
#### B. Public-Domain Artwork
Some Comfort Guild products feature historical or other artwork that we believe to be in the public domain in the United States.
**Comfort Guild does not claim copyright ownership in the underlying public-domain artwork itself merely because the artwork appears on a Comfort Guild product or through the Services.**
In many cases, Comfort Guild intentionally presents public-domain artwork in its original form because we value the original work and do not wish to materially alter it.
The fact that an underlying artwork is in the public domain, however, does not mean that every element appearing on a Comfort Guild product page or elsewhere through the Services is in the public domain.
Comfort Guild may separately own or control rights in its:
- product photography;
- mockups;
- written descriptions;
- branding;
- logos;
- promotional graphics;
- page layouts;
- collection arrangements;
- product presentation;
- packaging;
- photographs or videos depicting products;
- selection and coordination of materials; and
- other original Comfort Guild Content surrounding the public-domain work.
You may independently obtain and use an underlying public-domain artwork from a lawful independent source subject to applicable law.
However, public-domain status does not grant you permission to copy Comfort Guild's product photographs, mockups, website materials, branding, written content, or other independently protectable Comfort Guild Content.
You also may not represent an independently produced product as being manufactured by, affiliated with, endorsed by, or originating from Comfort Guild.
#### C. AI-Assisted and AI-Generated Artwork
Some artwork or other content used by Comfort Guild may be created with the assistance of artificial intelligence tools or may contain elements generated through artificial intelligence systems.
Comfort Guild distinguishes between AI used as a creative tool and expressive material produced entirely by an automated system.
Where a work includes protectable human-authored expression, including original human-created material, creative human modifications, editing, selection, coordination, arrangement, or other authorship recognized by applicable law, Comfort Guild claims rights in those human-authored elements to the fullest extent permitted by law.
Where particular material is determined to have been generated entirely by artificial intelligence without sufficient human authorship to qualify for copyright protection, Comfort Guild does not claim copyright in that purely machine-generated element beyond whatever rights, if any, are recognized by applicable law.
Regardless of the copyright status of a particular AI-generated component, other elements associated with the product or Services—including Comfort Guild branding, trademarks, product photography, mockups, human-authored text, layouts, arrangements, and other original materials—may remain independently protected.
Additionally, your access to and use of the Services remains subject to the contractual restrictions contained in these Terms, including the restrictions on scraping, automated extraction, dataset creation, and artificial intelligence training described below, to the fullest extent those restrictions are enforceable under applicable law.
### 6.4 No Transfer of Intellectual Property Upon Purchase
Purchasing a Comfort Guild product means that you are purchasing the physical product itself.
Unless we expressly agree otherwise in writing, you are **not** purchasing or receiving ownership of any underlying copyright, trademark, source file, digital artwork, commercial reproduction right, manufacturing right, licensing right, or other intellectual property right associated with the product.
No implied license is granted by the sale of a product.
### 6.5 Restrictions on Reproduction and Use
Except with Comfort Guild's prior written consent or to the extent a restriction is prohibited by applicable law, you may not reproduce, duplicate, copy, scan, photograph for reproduction purposes, trace, download, extract, distribute, republish, upload, transmit, sell, sublicense, commercially exploit, create unauthorized derivative works from, manufacture products from, or otherwise reuse Comfort Guild Content.
You may not remove, conceal, alter, or obscure copyright notices, trademark notices, watermarks, metadata, attribution information, technological restrictions, or other rights-management information associated with Comfort Guild Content.
Nothing in this subsection prevents lawful independent use of an underlying public-domain work obtained from an independent source. The restriction applies to Comfort Guild Content and to access, collection, or extraction from our Services, not to an attempt by Comfort Guild to remove an independently existing public-domain work from the public domain.
### 6.6 Scraping, Data Harvesting, and Automated Extraction
Unless Comfort Guild provides prior express written authorization, you may not directly or indirectly use any automated or systematic method to access, acquire, extract, reproduce, index, monitor, download, cache, archive, collect, or harvest information or Content from the Services except as expressly permitted under Section 6.7 for legitimate search, discovery, and referral purposes.
Prohibited technologies and methods include, without limitation:
robots, spiders, crawlers, scrapers, automated browsers, headless browsers, data-mining tools, extraction software, scripts, bots, artificial intelligence agents, computer-vision extraction systems, automated downloaders, or substantially similar methods when used for a prohibited purpose under these Terms.
You may not use manual processes in a coordinated or systematic manner to accomplish substantially the same result.
You also may not circumvent or disregard CAPTCHAs, rate limits, authentication mechanisms, access controls, technical restrictions, or other measures intended to regulate automated access.
Machine-readable restrictions, robot exclusion instructions, metadata, headers, or similar technical signals published through or in connection with the Services must be respected in accordance with their stated purpose and applicable law.

## 6.7 Artificial Intelligence, Machine Learning, Search, and Product Discovery
Comfort Guild recognizes that search engines, artificial intelligence-powered search services, shopping assistants, recommendation systems, and other discovery technologies may assist customers in locating, comparing, learning about, or purchasing our products.
Accordingly, nothing in this Section is intended to prohibit ordinary and legitimate:
- search-engine crawling and indexing;
- product discovery;
- shopping search;
- citation of Comfort Guild pages;
- linking to Comfort Guild pages;
- generation of short descriptive snippets;
- search result previews;
- user-requested retrieval of individual Comfort Guild pages;
- AI-powered search or recommendation of Comfort Guild products;
- presentation of factual product information in response to a user's search or shopping request; or
- referral of users to Comfort Guild or an authorized Comfort Guild sales channel,
provided that such activity complies with our applicable technical access controls, does not materially substitute for the Services themselves, and does not involve prohibited bulk collection, dataset creation, or model development as described below.
### 6.7.1 Permitted Discovery Does Not Authorize Model Training
Permission for search, indexing, discovery, citation, recommendation, or referral does **not** constitute permission to use Comfort Guild Content for artificial intelligence or machine-learning model training.
Except with Comfort Guild's prior express written consent, you may not use, copy, scrape, harvest, download, extract, ingest, reproduce, retain, process, or otherwise collect Comfort Guild Content or data obtained from the Services for the purpose of:
- training an artificial intelligence or machine-learning model;
- pre-training a model;
- fine-tuning a model;
- reinforcement learning;
- developing or improving a generative AI system;
- constructing or augmenting a training dataset;
- constructing or augmenting an image, text, audio, or multimodal dataset;
- creating a corpus intended for model development;
- generating synthetic training data derived from Comfort Guild Content;
- evaluating or benchmarking models where Comfort Guild Content is retained as part of a reusable evaluation dataset;
- developing systems intended to imitate, reproduce, or learn from Comfort Guild artwork, designs, written content, visual presentation, or other proprietary materials; or
- supplying material to another person or organization for any of the foregoing purposes.
### 6.7.2 Bulk Collection and Dataset Creation
You may not engage in bulk, systematic, or persistent collection of Comfort Guild Content for the purpose of building, maintaining, selling, licensing, distributing, or contributing to:
- artificial intelligence datasets;
- machine-learning datasets;
- image datasets;
- text corpora;
- data archives;
- commercial data repositories;
- model-development databases; or
- similar collections intended primarily for computational training, development, or analysis.
The fact that material is publicly accessible does not constitute authorization for bulk collection or dataset creation.
### 6.7.3 Search and Retrieval Systems
Search engines, AI-powered search services, shopping assistants, and retrieval systems may process Comfort Guild Content as reasonably necessary to locate, index, describe, cite, recommend, or retrieve relevant Comfort Guild pages in response to user requests, provided that such processing is consistent with applicable technical controls and is not used as a pretext for prohibited training or bulk data acquisition.
Temporary caching, embeddings, indexing, or other technical processing reasonably necessary to operate a legitimate search, retrieval, citation, recommendation, or referral service is not prohibited solely by this Section, provided that such processing is not used to create or improve a general-purpose or specialized model and does not result in the unauthorized creation of a reusable training dataset containing Comfort Guild Content.
### 6.7.4 Generative Output and Product Discovery
Nothing in these Terms is intended to prohibit a search engine, AI assistant, shopping assistant, or similar service from identifying, describing, citing, linking to, or recommending Comfort Guild or Comfort Guild products in response to a user's request.
Such services may provide factual summaries of publicly available product information where reasonably necessary to assist users in discovering Comfort Guild products.
However, this permission does not authorize reproduction of substantial portions of Comfort Guild Content, redistribution of our artwork or product images as substitute content, creation of competing product catalogs derived from our Services, or generation of unauthorized reproductions of Comfort Guild designs.
### 6.7.5 No Implied Training License
No permission granted or recognized under this Section creates an implied license to use Comfort Guild Content for artificial intelligence training, model development, dataset creation, or other uses expressly prohibited by these Terms.
The absence of a technical barrier preventing access does not constitute consent to use Comfort Guild Content for artificial intelligence or machine-learning training.
Likewise, the fact that Comfort Guild permits a crawler or automated service to access certain pages for search or product-discovery purposes does not constitute permission to use those pages for model training or dataset development.
### 6.7.6 Technical Signals and Crawler-Specific Permissions
Comfort Guild may use robots.txt directives, crawler-specific instructions, metadata, HTTP headers, platform settings, or other technical mechanisms to communicate whether particular automated systems may access or use portions of the Services.
Permissions granted to one crawler, service, or category of automated system do not automatically apply to another.
For example, authorization for a search or product-discovery crawler does not constitute authorization for a crawler whose primary purpose is artificial intelligence model training or dataset collection.
Automated systems must respect applicable crawler-specific permissions and restrictions published by Comfort Guild to the extent required by applicable law.

### 6.8 Third-Party Dataset and Model Providers
You may not sell, license, contribute, provide, disclose, upload, or otherwise transfer Comfort Guild Content obtained from the Services to an AI developer, model provider, dataset provider, data broker, model-training service, machine-learning company, or other third party for a purpose prohibited under Section 6.7.
This restriction does not prohibit lawful referrals, citations, links, or product-discovery information supplied to legitimate search engines, shopping services, or AI-powered discovery services in accordance with Section 6.7.
### 6.9 Reservation of Rights
Except for rights expressly granted under these Terms, all rights in Comfort Guild Content are reserved.
Nothing in these Terms shall be interpreted to claim exclusive ownership over underlying material that is lawfully in the public domain or otherwise not subject to proprietary protection.
Nothing in this Section is intended to interfere with lawful search-engine indexing, legitimate product discovery, citation, linking, or customer referral conducted in accordance with these Terms.

## SECTION 7 - OPTIONAL TOOLS
You may be provided with access to customer tools offered by third parties as part of the Services that we neither monitor nor control.
You acknowledge and agree that we provide access to such tools “as is” and “as available” without warranties, representations, endorsements, or conditions of any kind.
We shall have no liability arising from or relating to your use of optional third-party tools.
Your use of optional tools is at your own risk and discretion, and you should review and understand the terms applicable to those third-party tools.
We may offer additional features, tools, or resources in the future. Such features will be considered part of the Services and subject to these Terms unless otherwise stated.

You are solely responsible for the Feedback you submit and its accuracy.
We may, but are not required to, monitor, edit, refuse, or remove Feedback that we determine violates these Terms or is unlawful, defamatory, threatening, obscene, fraudulent, infringing, or otherwise objectionable.

(h) to impersonate Comfort Guild, Shopify, another customer, or any other person or entity;
(i) to falsely imply sponsorship, affiliation, endorsement, or association with Comfort Guild;
(j) to counterfeit, reproduce, manufacture, sell, or advertise unauthorized copies of Comfort Guild products or Comfort Guild Content;
(k) to copy product artwork for use on competing or substitute merchandise;
(l) to access, extract, or collect Comfort Guild Content for prohibited dataset creation, artificial intelligence training, model development, or machine learning in violation of Section 6.7;
(m) to engage in systematic scraping, crawling, downloading, archiving, or data harvesting except for legitimate search, indexing, product-discovery, citation, retrieval, or referral activities expressly permitted under Section 6.7;
(n) to use automated means to circumvent purchasing limits, security measures, rate limits, access restrictions, or technical controls;
(o) to interfere with the operation, integrity, performance, or security of the Services; or
(p) to engage in other conduct that restricts or inhibits another person's lawful use of the Services or that may expose Comfort Guild, Shopify, our customers, or other persons to harm or liability.
In addition, you agree not to upload or transmit malicious code; reproduce, duplicate, copy, extract, sell, resell, or exploit unauthorized portions of the Services; collect or track personal information concerning others; engage in phishing, pharming, pretexting, or similar activities; or bypass security, authorization, or access-control measures.
We reserve the right to suspend, restrict, disable, or terminate access to the Services if we reasonably determine that these Terms have been violated.

# SECTION 14 - AUTOMATED AGENTS
## 14.1 Definition
For purposes of these Terms, an “Agent” means software or a service that takes autonomous or semi-autonomous actions on behalf of or at the instruction of a person or entity, including AI agents, automated purchasing agents, assistants, bots, and similar technologies.
## 14.2 Permitted Agent Access
An Agent may access or interact with the Services to the extent such access is permitted by Comfort Guild and Shopify and is not otherwise prohibited by these Terms.
Permitted Agent activity may include legitimate product discovery, search, retrieval, recommendation, comparison, or purchasing assistance performed on behalf of a user.
Compliance with this Section 14 does **not** authorize an Agent to scrape, harvest, download, reproduce, systematically collect, or use Comfort Guild Content for datasets, AI training, machine learning, competitive data aggregation, or another activity prohibited under Sections 6 or 13.
## 14.3 Technical Restrictions
